You have the right to refuse unsafe work

We all want to get the job done right. But no job is worth risking your health or your life.If you have reasonable cause to believe a task could put you, a co-worker or someone else in danger, you have the legal right to refuse unsafe work.

Maybe equipment isn’t working properly. Maybe you’re being asked to use the wrong tools, work without the right training or PPE, or do something in unsafe conditions. Whatever the reason, trust your instincts and follow the process.

What should you do?

If you believe the work is unsafe, stop and tell your supervisor. Give your employer a chance to investigate and fix the problem.

If you still believe the work is unsafe, ask for a union representative, worker representative or health and safety committee member to be involved.

Can your employer punish you?

Workers who follow the legal process for refusing unsafe work are protected from discipline or retaliation. While the issue is being investigated, your employer may assign you other work, but you shouldn’t lose pay for doing so.

Contact your shop steward as soon as possible. They can help make sure the correct process is followed and that your rights are protected.

If something doesn’t seem safe, say something. Looking out for each other is one of the most important things we do. You have the right to stop, ask questions and make sure everyone goes home safely.
