ARTICLE 18.07 RIGHT TO REFUSE OVERTIME

The Union has become aware of recent assertions being made relating to Article 18.07, the right to refuse overtime. Specifically, subsection (a) 3. the completion of a maximum of one additional round-trip.

The additional round-trip refers to sailings over and above scheduled sailings.  It is not a requirement to work a next scheduled PM round-trip after working an AM shift.

Examples of the application of 18.07(a)3.

  1. Vessel secures after 8 hours of sailing and there are no more scheduled sailings but there is a full parking lot and the vessel is required to sail again. This is an additional round trip as considered in 18.07. 18.07(a)3 applies.
  2. Vessel secures after 8 hours of sailing (AM shift). The next round trip (PM Shift) is scheduled but there is a lack of crew available, and you’ve been told to stay. This is not an additional round as considered in 18.07. 18.07(a)3 does not apply.
